1. Scope of Application

These General Terms and Conditions (AGB) apply to all contracts between Foto Tek (hereinafter "Provider") and their customers (hereinafter "User") regarding the use of the QR menu application. These AGB apply exclusively to entrepreneurs within the meaning of § 14 BGB (B2B). Contracts with consumers are excluded.

2. Subject Matter of Contract

The Provider makes available to the User a digital QR menu application with which online menus can be created, managed and displayed via QR codes. A specific economic success is not guaranteed.

3. Registration and Use

The User is obliged to provide complete and truthful information when registering. The User is solely responsible for all content posted by him. The Provider assumes no liability for the User's content.

4. Prices and Billing

The usage fee is €200.00 per year plus 19% statutory VAT. Billing is done annually in advance. After payment is received, the User will receive a proper invoice.

5. Payment Methods

Payment can be made by SEPA transfer (advance payment), credit or debit card, or via online payment services (e.g. PayPal), if offered.

6. Contract Term and Automatic Renewal

The contract is concluded for a minimum term of 12 months. It automatically renews for a further 12 months unless it is terminated in writing (email is sufficient) at least 30 days before the end of the term.

7. Payment Default and Reminder Fees

If the User defaults on payment, the Provider is entitled to charge a reminder fee of €20.00 per reminder. In addition, statutory default interest according to § 288 BGB can be claimed. In case of a payment default of more than 14 days, access to the application may be temporarily blocked.

8. No Right of Withdrawal

A right of withdrawal does not exist, as it is a digital service in the B2B sector and the User agrees to immediate performance.

9. Liability

The Provider is only liable for damages that are based on intent or gross negligence. Liability for data loss, server failures or internet disruptions is excluded.

10. Data Protection

The processing of personal data is carried out in accordance with applicable data protection laws, in particular the GDPR.

12. Final Provisions

The law of the Federal Republic of Germany applies. The place of jurisdiction is Berlin, if legally permissible. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
